CONTRACT FOR THE PROVISION OF ONLINE EDUCATIONAL SERVICES
From one side,
Centro de Estudios Luis Vives SL, with CIF B82406109 , and on the other hand the student: (DATA PROVIDED THROUGH ELECTRONIC FORM)
AGREE
Sign a contract for the provision of services, according to the personal, contact and payment information provided by the student, and in accordance with the following
STIPULATIONS
1. The student declares to have read and understood the information provided by Centro de Estudios Luis Vives SL through its website www.cursalia.online and other websites indicated in clause 13, regarding the course, its characteristics and conditions, services, fees and payment methods, as well as the legal notice and privacy policy . Once the acceptance of this contract has been formalized, and after the full amount of the course has been paid, Centro de Estudios Luis Vives SL undertakes to provide the student, within a period not exceeding 48 hours , with the access credentials to the online platform to access the virtual units that make up the course, as well as all the related teaching tools.
2. The student has the right, during the contracted license period starting from the acceptance of this agreement, through the open and distance learning system they subscribe to, to access the content, materials, and tools provided in the course. Centro de Estudios Luis Vives SL offers the option to extend this period through the website www.cursalia.online . Centro de Estudios Luis Vives SL is the intellectual property owner of all educational resources contained on cursalia.online.
3. The studies undertaken do not have official academic validity and do not lead to the awarding of a degree. Upon completion of the course, Centro de Estudios Luis Vives SL will issue a certificate of completion. To obtain this certificate, the student must successfully complete all the requirements previously indicated on the course platform.
4. The student agrees to pay the full course fee in accordance with the terms and conditions stipulated in this contract. This course contract is personal and non-transferable, except with the express authorization of Centro de Estudios Luis Vives SL . If, at the student's unilateral decision, a refund is requested, and after receiving the relevant notifications of non-payment, the student's access to the online campus will be deactivated, and therefore, they will cease to receive all services related to the contracted course, without prejudice to the student's obligation to pay the agreed amounts. If, due to reasons attributable to Centro de Estudios Luis Vives , the contracted services, as offered on its website, are not provided at any time, the student will be refunded the amounts paid for the course, less the proportional amount corresponding to the period in which the services were offered.
Centro de Estudios Luis Vives SL is not responsible for any problems arising from the interruption of services provided by the student's access provider, nor for service interruptions due to power outages affecting the access provider's system, failures in the transmission or internet access system, incompatibility of user systems with those of the access provider, or any third-party actions that prevent the provision of the service due to unforeseen circumstances or force majeure.
Any technical problems related to the use of cursalia.online should be sent by the student to the email address cursalia@luis-vives.es . The Center guarantees a response to this email within a maximum of 48 business hours from receipt.
5. Centro de Estudios Luis Vives SL reserves the right to terminate the contract in case of non-compliance by the student with the payment obligations assumed in this contract.
6. In the event that the account holder is different from the student, the account holder agrees to pay the total amount of the course.
7. So that the student can exercise his right to be informed of any incidents that may arise from this contract, he will reliably communicate any email change he makes, in order to maintain normal relations with him.
8. The student acknowledges that he or she sufficiently understands the Spanish language, as well as the contract that he or she voluntarily signs, expressly acknowledging that he or she has sufficient knowledge of the Spanish language, both oral and written, to take the course that he or she is contracting for, and that therefore he or she can assume the study and preparation thereof.
9. It is stated that there will be no right of withdrawal regarding the provision of services when their execution has already begun. In this sense, in accordance with the provisions of article 103 m) of Royal Legislative Decree 1/2007, of November 16, which approves the consolidated text of the General Law for the Defense of Consumers and Users and other laws complementary, the right of withdrawal will not be applicable to those contracts in which:
"The supply of digital content that is not provided on a material medium when performance has begun and, if the contract imposes a payment obligation on the consumer or user, when the following conditions are met:
The consumer or user has given prior consent to start the execution during the period of the right of withdrawal.
The consumer or user has expressed their knowledge that, consequently, they lose their right of withdrawal; and
The entrepreneur has provided confirmation in accordance with article 98.7 or article 99.2"
In this sense, by accepting these purchase conditions the student expressly consents to the loss of his right of withdrawal in accordance with the provisions of article 98.7 of RDL 1/2007.
Therefore, as long as the student has accessed the online platform with their passwords, no cause for withdrawal and/or termination of this contract that is not legally provided for will be accepted, with both parties obligated to fully comply with the obligations contracted in the present contract.
10. The product purchased is for the exclusive use of the student, with the information provided to Centro de Estudios Luis Vives SL . Only one course completion certificate will be issued in the name of the registered student, and under no circumstances will more than one certificate be issued to any other identity than the one provided by the student at the beginning of the course.
11. Technical requirements and user responsibility to access multimedia resources:
- The student acknowledges and agrees that, in order to fully access and benefit from the multimedia resources, including Adobe PDF documents and videos hosted on YouTube, offered on the online course platform, it is the student's sole responsibility to comply with the following technical requirements:
- PDF document viewer: the student must have a compatible PDF document viewer, with Adobe Reader being a recommended option. The installation and configuration of said viewer is the responsibility of the student.
- Internet Connection: Access to videos hosted on YouTube requires a stable Internet connection. The student will be responsible for guaranteeing an adequate connection for viewing the multimedia content.
- Compatible device: The student must have a compatible device (computer, tablet, mobile phone, etc.) capable of playing videos and viewing PDF documents effectively.
- The student understands that access to YouTube may be subject to geographic restrictions and platform-specific conditions. It is the sole responsibility of the student to ensure that YouTube is available in their region and that they comply with YouTube's terms and conditions of use, including acceptance of cookies in accordance with the platform's privacy policies.
- Centro de Estudios Luis Vives, SL does not assume responsibility for technical difficulties or access limitations that may arise due to the student's failure to comply with the requirements mentioned above. Any technical issues related to software installation, internet connection, or YouTube geographic restrictions will be the sole responsibility of the student.
- By accepting the terms and conditions of the course, the student expresses his or her understanding and acceptance of the technical requirements and responsibilities described in this clause to access the multimedia resources provided.
12. Centro de Estudios Luis Vives SL will provide access codes to the student who has enrolled. These access codes are for personal use only and are non-transferable. The student is responsible for safeguarding these passwords and for their exclusive use.
13. Students are expressly advised that the use of course access passwords by unauthorized persons (other than the student) may result in the cancellation of the contract by Centro de Estudios Luis Vives SL , without refund of the course fee. Students may use their passwords from different computers, but may not share them with third parties or distribute them or the course content through any means of communication for any purpose other than their own use. Upon verification of such activity by Centro de Estudios Luis Vives SL , the contract will be canceled, the passwords will be deactivated, and no refund of the course fee will be issued. Furthermore, appropriate legal action will be taken regarding the infringement of intellectual property rights.
14. Regarding the course content and conditions, Centro de Estudios Luis Vives SL is only responsible for the information it provides on its websites: www.cursalia.online , www.luis-vives.es , www.spanishluisvives.com , www.academiaparauniversitarios.es , and www.bravosol.net . It is not responsible for any erroneous, incomplete, or questionable information that may be provided by any other person or collaborating company during the sales or marketing process.
15. Centro de Estudios Luis Vives SL is a company that operates worldwide, with headquarters in Madrid. This means that its courses are geared towards the exams administered in this region. Although the official exam content is established nationally through Decrees published in the Official State Gazette (BOE), the various Autonomous Communities and other bodies may implement curricular adaptations or modifications to the official exam format. While Centro de Estudios Luis Vives SL strives to provide accurate and clear information about these adaptations, it is the student's responsibility to be familiar with the content and exam format of the official exam they will be taking.
16. Students are responsible for completing any information and registration required to take official tests or exams. Centro de Estudios Luis Vives SL will inform students of relevant announcements through its various communication channels. This information service is provided as a courtesy by the Center, and students are not liable for any errors or omissions that may occur.
17. Cursalia.online offers its services uninterruptedly. These courses have modalities that include the intervention of the Center's teaching staff. For these courses, the support of the teaching staff and the online classes will occur according to the work calendar of the city of Madrid, as well as the school calendar of the Community of Madrid.
18. The parties agree, waiving any other jurisdiction that may apply to them, expressly submit to Spanish law and the jurisdiction and competence of the Courts and Tribunals of the city of Madrid.
