CONTRACT FOR THE PROVISION OF ONLINE EDUCATIONAL SERVICES

AGREE

Sign a contract for the provision of services, according to the personal, contact and payment information provided by the student, and in accordance with the following

STIPULATIONS

1. The student declares to have read and understood the information provided by Centro de Estudios Luis Vives SL through its website www.cursalia.online and other websites indicated in clause 13, about the course, its characteristics and conditions, services, fees and payment methods, as well as the legal notice and privacy policy, once the acceptance of this contract has been formalized, and after the payment of the full amount of the course has been made, Centro de Estudios Luis Vives SL undertakes to provide the student, within a period no more than 48 hours, the access credentials to the online platform to access the virtual units of which the course consists, as well as all the teaching tools linked to it.

2. The student has the right, during the contracted license period From the acceptance of this contract, through the open and distance learning system that is contracted, to access the contents, materials and tools provided in the course content. Luis Vives SL Study Center. offers the option to extend this period through the website www.cursalia.online. Luis Vives SL Study Center. is the intellectual owner of all educational resources contained in cursalia.online.

3. The studies completed lack official academic validity and do not lead to obtaining your own degree. When the student finishes the course, Luis Vives SL Study Center. will provide a certificate of the studies completed. To obtain this certificate, the student must satisfactorily complete all the requirements previously indicated on the course platform.

4. The student agrees to pay the total amount of the course in accordance with the conditions requested and agreed in this contract. This teaching contract is personal and non-transferable, unless expressly authorized by Luis Vives SL Study Center. If, by unilateral decision of the student, the payment is returned, and after having received the pertinent notifications of non-payment, the user will be deactivated from accessing the online campus and, therefore, will stop receiving all the services related to the contracted course, without prejudice to the obligation on the part of the student to satisfy the agreed amounts. Yes, for reasons attributable to Luis Vives Study Center, at any time the contracted services contemplated in the offer on its website are not offered, the student will be refunded the amounts paid for the course, discounting the proportional amount corresponding to the period in which the services have been offered.

Luis Vives SL Study Center. is not responsible for eventual problems arising from the interruption of the services of the student's access provider, nor for the interruption of services in the case of lack of electrical energy for the system of their access provider, failures in the transmission system. or navigation in Internet access, incompatibility of the users' systems with those of the access provider or any action of third parties that prevent the provision of the service resulting from a fortuitous event or force majeure.

Any technical problem related to the use of cursalia.online must be sent by the student to the email address cursalia@luis-vives.es. The Center guarantees a response to this email within a maximum period of 48 business hours from receipt.

5. Luis Vives SL Study Center. reserves the right to terminate the contract in the event of non-compliance by the student with the payment obligations assumed in this contract.

6. In the event that the account holder is different from the student, the account holder agrees to pay the total amount of the course.

7. So that the student can exercise his right to be informed of any incidents that may arise from this contract, he will reliably communicate any email change he makes, in order to maintain normal relations with him.

8. The student acknowledges that he or she sufficiently understands the Spanish language, as well as the contract that he or she voluntarily signs, expressly acknowledging that he or she has sufficient knowledge of the Spanish language, both oral and written, to take the course that he or she is contracting for, and that therefore he or she can assume the study and preparation thereof.

9. It is stated that there will be no right of withdrawal regarding the provision of services when their execution has already begun. In this sense, in accordance with the provisions of article 103 m) of Royal Legislative Decree 1/2007, of November 16, which approves the consolidated text of the General Law for the Defense of Consumers and Users and other laws complementary, the right of withdrawal will not be applicable to those contracts in which:
"The supply of digital content that is not provided on a material medium when performance has begun and, if the contract imposes a payment obligation on the consumer or user, when the following conditions are met:
The consumer or user has given prior consent to start the execution during the period of the right of withdrawal.
The consumer or user has expressed their knowledge that, consequently, they lose their right of withdrawal; and
The entrepreneur has provided confirmation in accordance with article 98.7 or article 99.2"
In this sense, by accepting these purchase conditions the student expressly consents to the loss of his right of withdrawal in accordance with the provisions of article 98.7 of RDL 1/2007.

Therefore, as long as the student has accessed the online platform with their passwords, no cause for withdrawal and/or termination of this contract that is not legally provided for will be accepted, with both parties obligated to fully comply with the obligations contracted in the present contract.

10. The contracted product is for the exclusive use of the student, with the data provided to Luis Vives SL Study Center. Only one course completion certificate will be issued in the name of the registered student, and in no case will more than one certificate be issued to another identity other than the one provided by the student at the beginning of the course.

11. Technical requirements and user responsibility to access multimedia resources:

1. The student acknowledges and agrees that, in order to fully access and benefit from the multimedia resources, including Adobe PDF documents and videos hosted on YouTube, offered on the online course platform, it is the student's sole responsibility to comply with the following technical requirements:
   • PDF document viewer: the student must have a compatible PDF document viewer, with Adobe Reader being a recommended option. The installation and configuration of said viewer is the responsibility of the student.
   • Internet Connection: Access to videos hosted on YouTube requires a stable Internet connection. The student will be responsible for guaranteeing an adequate connection for viewing the multimedia content.
   • Compatible device: The student must have a compatible device (computer, tablet, mobile phone, etc.) capable of playing videos and viewing PDF documents effectively.
2. The student understands that access to YouTube may be subject to geographic restrictions and platform-specific conditions. It is the sole responsibility of the student to ensure that YouTube is available in their region and that they comply with YouTube's terms and conditions of use, including acceptance of cookies in accordance with the platform's privacy policies.
3. Centro de Estudios Luis Vives, SL does not assume responsibility for technical difficulties or access limitations that may arise due to the student's failure to comply with the requirements mentioned above. Any technical issues related to software installation, internet connection, or YouTube geographic restrictions will be the sole responsibility of the student.
4. By accepting the terms and conditions of the course, the student expresses his or her understanding and acceptance of the technical requirements and responsibilities described in this clause to access the multimedia resources provided.

12. Luis Vives SL Study Center will provide access codes to the student who made the contract. These access codes are for personal use and non-transferable. The student must be responsible for the custody of said passwords and their exclusive use.

13. It is expressly noted that the use of passwords to access the course by unauthorized persons (other than the student) may lead to the cancellation of the contract by Luis Vives SL Study Center, without refund of the course fee. The student may use his/her passwords from different computer equipment, but may not share with third parties, nor disseminate said passwords or the contents of the course through any means of communication, for purposes other than the student's own use. The detection of this fact by Luis Vives SL Study Center, once verified, will be grounds for canceling the contract, canceling the passwords, and without the possibility of any refund of the course fee; in addition to the execution of the relevant legal actions regarding infringement of intellectual property rights.

14. Regarding the contents and conditions of the course, Luis Vives SL Study Center. is only responsible for the information provided by itself on its web pages www.cursalia.online, www.luis-vives.es, www.spanishluisvives.com, www.academiaparauniversitarios.es, www.bravosol.net. Therefore, it is not responsible for any erroneous, incomplete or doubtful information that any other person or collaborating company may convey during the sales or marketing process.

15. Luis Vives SL Study Center. is a company that operates worldwide, with headquarters in Madrid. This means that their courses are oriented to the tests held in this Community. Although the official contents of the tests are contemplated at the national level, through the Decrees published in the BOE, the different Autonomous Communities and other organizations can carry out curricular adaptations or official exam formats. Yes ok Luis Vives SL Study Center. Try to inform truthfully and clearly about these adaptations; it will be the student's responsibility to know the contents and exam format of the official test they are going to take.

16. The information and registrations that the student must formalize to take official tests or exams will be made by the student himself. Luis Vives SL Study Center. will inform, through its various dissemination channels, of the calls that are of interest to its students, this information service being a mere courtesy of the Center, so any unwanted error or omission that may occur could not be subject to complaint by the students.

17. Cursalia.online offers its services uninterruptedly. These courses have modalities that include the intervention of the Center's teaching staff. For these courses, the support of the teaching staff and the online classes will occur according to the work calendar of the city of Madrid, as well as the school calendar of the Community of Madrid.

18. The parties agree, waiving any other jurisdiction that may apply to them, expressly submit to Spanish law and the jurisdiction and competence of the Courts and Tribunals of the city of Madrid.
